Are prediction markets legal in Washington?

It is contested and Washington has taken a hard line. The state gambling regulator said in December 2025 that event contracts are not authorized in Washington, and in late March 2026 the attorney general sued an operator for illegal gambling. Operators and the federal regulator argue federal law preempts state rules. The question was unresolved as of May 2026.

Did Washington sue a prediction market operator?

Yes. In late March 2026 the Washington attorney general filed suit against a prediction market operator, alleging its product is illegal gambling under the state Gambling Act and the Consumer Protection Act. The state has also clashed in court with another operator.

Who regulates these markets in Washington?

Federally listed event contracts fall under the Commodity Futures Trading Commission. At the state level, the Washington State Gambling Commission oversees gambling and the attorney general enforces state law. The two views are in direct conflict over event contracts.

Is offshore access legal from Washington?

Washington has a strict gambling regime and the position on platforms that operate without United States registration is contested, with added risk around funds and recourse. We mark it as higher risk and do not link to such venues.
