A federally regulated market does not need a separate Washington licence to offer its core event contracts, which is why it can be available to Washington residents even where state gambling rules are strict. The live friction is mostly around sports-event contracts, where some states have pushed back.

As of May 2026 the answer is contested and unresolved. The Washington State Gambling Commission has said event contracts are not authorized in Washington, the state has sued a partner exchange, and Robinhood has sued the state arguing federal preemption.
